Surrogacy in CyprusSurrogacy in Cyprus- An Overview

Surrogacy has emerged as a viable option for single parents and childless couples who are struggling with infertility or other reproductive challenges. The surrogacy law in Cyprus is favorable. Cyprus has enacted laws that regulate and govern surrogacy arrangements within its borders.

The legislation ensures that the rights of all parties involved, including the surrogate mother, intended parents, and the child, are protected. The legal framework in Cyprus provides clarity and security for those considering surrogacy.

The legal framework for surrogacy in Northern Cyprus is established by Law 57-2014, specifically the Law on the Rules of Human Cell, Tissue, and Organ Transport Regulation (Number: 607/2009, Date: 26.08.2009) and the Urea Treatment Centers and Methods Regulation.

Interestingly, the clinics in Northern Cyprus do not require a Marriage Certificate or Medical Certificate to initiate the surrogacy process.

In terms of the birth certificate, both the biological father and the surrogate mother are named, and there is no mechanism in place to remove the surrogate mother’s name from the birth certificate.

Introduction to Gestational Surrogacy

Surrogacy is a method of assisted reproduction where a woman carries a pregnancy and gives birth to a child on behalf of another person or couple. It involves a legal agreement between the intended parents and the surrogate, outlining the terms and conditions of the arrangement. Surrogacy provides an opportunity for individuals or couples who are unable to conceive or carry a pregnancy to have a biological child.

Benefits of Surrogacy in Cyprus

Surrogacy in Cyprus offers several advantages that attract intended parents from around the world:

  • High-Quality Medical Facilities: Cyprus boasts modern medical infrastructure and advanced fertility clinics that provide comprehensive reproductive services.
  • Favorable Legal Environment: The legal system in Cyprus recognizes and supports surrogacy, ensuring the rights and responsibilities of all parties involved. The legal process is streamlined and provides clarity, minimizing potential confusion or legal complications.
  • Cultural Acceptance: Cyprus has a culturally accepting environment towards surrogacy. Society is generally open-minded and understanding of the diverse paths to parenthood, which can provide emotional support to intended parents.
  • Cost-Effective Option: The cost of surrogacy in Cyprus is much more affordable compared to other countries offering similar services. The cost of medical procedures, legal processes, and overall surrogacy arrangements can be relatively lower, making it an attractive option for individuals or couples with budget considerations.

Who is eligible for surrogacy in Cyprus?

Surrogacy programs are open to both married hetero couples, unmarried intended couples, as well as single intended parents.

Intended parents can be single male or gay couples who wish to grow their families via surrogacy arrangements.

There is no specific age limit imposed on intended couples for pursuing surrogacy in Cyprus.

Process of Surrogacy in Cyprus

The process of surrogacy in Cyprus typically involves several key steps:

  1. Finding a Surrogacy Agency: Intended parents usually begin by engaging a reputable surrogacy agency in Cyprus. These agencies play a crucial role in facilitating the surrogacy process, connecting intended parents with suitable surrogate mothers, and coordinating medical and legal aspects.
  2. Medical Evaluations and Screening: Both the intended parents and the surrogate mother undergo comprehensive medical evaluations and screenings. These assessments ensure that all parties involved are in good health and suitable for the surrogacy journey.
  3. Legal Contracts and Agreements: Legal professionals experienced in surrogacy law draft and review contracts and agreements between the intended parents and the surrogate mother. These documents outline the rights, responsibilities, and financial arrangements, providing a clear framework for the surrogacy process.
  4. IVF Treatment and Embryo Transfer: In gestational surrogacy, the intended mother or an egg donor undergoes ovarian stimulation and egg retrieval. The retrieved eggs are fertilized with the sperm from the intended father or a sperm donor to create embryos. One or more embryos are then transferred to the surrogate’s uterus through a carefully orchestrated IVF procedure.
  5. Pregnancy and Birth: Once the embryo transfer is successful, the surrogate mother carries the pregnancy to term. Throughout the pregnancy, regular medical check-ups and monitoring take place to ensure the health and well-being of both the surrogate and the developing baby.

When the time comes, the surrogate gives birth, and the intended parents are legally recognized as the child’s parents.

Risks and Challenges of Surrogacy in Cyprus

While surrogacy in Cyprus offers numerous benefits, it is essential to be aware of the potential risks and challenges involved:

  • Emotional and Psychological Considerations: Surrogacy can be an emotionally intense journey for all parties involved. Intended parents may experience a range of emotions, including anxiety, attachment concerns, and the complexities of the parent-surrogate relationship.
  • Legal and Ethical Issues: Despite the supportive legal framework, surrogacy can still present legal and ethical challenges. It is vital to work with experienced legal professionals to navigate the legal complexities and ensure that all parties’ rights and obligations are protected.
  • Medical Risks: As with any pregnancy, there are inherent medical risks involved. The surrogate mother may experience complications during pregnancy and childbirth, and the intended parents should be prepared for unforeseen circumstances. Access to quality healthcare and appropriate insurance coverage is crucial.
  • Not very popular:  Unlike eastern European like Georgia and Ukraine, Cyprus is not so popular.
  •

Success Rates of Surrogacy in Cyprus

The success rates of surrogacy clinic in Cyprus is generally encouraging and are around 75% with egg donor surrogacy programs. Surrogate Mothers in Cyprus

Surrogate mothers in Cyprus undergo a thorough selection process that holds significant importance throughout the surrogacy journey. In Cyprus, potential surrogates undergo comprehensive background checks, physical examinations, and mental evaluations before being chosen.

Moreover, they receive continuous monitoring and support throughout the entire pregnancy period. Adding to the peace of mind of intended parents, it is customary for surrogate mothers in Cyprus to give birth in private maternity hospitals.

If the baby’s birth takes place in Cyprus, the surrogate mother’s name will be listed alongside the intended father (bio father) as the parent. The inclusion of both intended parents’ names is a complex matter that requires the guidance of a competent attorney.

To obtain the full legal rights of the baby and to take the baby back to your home country, a parental order is required.

In case you are planning to use a surrogate mother from Cyprus, it is highly suggested to engage the services of a reputable surrogacy agency in Cyprus or abroad who have years of experience dealing with the nitty-gritty of surrogacy services. We provide comprehensive support throughout the entire surrogacy journey, from selecting the most suitable surrogate mother to navigating the legal aspects to ensure a successful claim of your baby if the birth occurs in Cyprus.

is surrogacy legal in Cyprus

Is surrogacy Legal in Cyprus?

Yes, surrogacy is legal in Cyprus.  However, like UK and Australia, the surrogacy agreements are not enforceable and the surrogate mother is a legal parent who needs to give up her rights so that the commissioning parent can adopt via court order

If a single surrogate woman gives birth to a child and subsequently transfers the child to the intended couple, the legal framework outlined in Law 187/91 comes into effect. According to this law, the child is considered to be the child of the intended father and the surrogate woman, as the child is born out of wedlock. Establishing the paternity of the child in such cases can be done through voluntary acknowledgment or a Court order.

Once a voluntary acknowledgment is made, it cannot be revoked. In this situation, it is necessary for the intended father to obtain the consent of the surrogate woman, due to the fact that as a birth mother, she is considered the legal mother of the child. Subsequently, the intended couple should proceed by applying to the court for the adoption of the child. The application should be made jointly by the intended father and his wife, who is the intended mother.

In summary, if a single surrogate woman gives birth to a child and transfers parental rights to the intended couple, the intended father establishes paternity through acknowledgment or a Court order. Then, the commissioning couple must apply for adoption through a joint application made by the intended father and his wife.

According to Cyprus Adoption Law 19(I)/1995, an adoption order can be granted if specific conditions are fulfilled. These conditions involve obtaining consent from the surrogate woman, who is considered the child’s natural mother in this case. The consent must be provided at least three months after the child’s birth. Additionally, it is required that the child has resided with the adoptive parents, namely the commissioning couple, continuously for the preceding three months.

As per the adoption process in Cyprus, fulfilling these conditions allows for the possibility of obtaining an adoption order, which legally establishes the commissioning couple as the adoptive parents of the child. The law ensures that the child’s well-being and stability are taken into consideration throughout the adoption process.

In a scenario where the surrogate woman is married and the child is the result of assisted procreation procedures conducted with the consent of her husband, the legal father is the surrogate’s husband rather than the intended father.

In such cases, both the surrogate and her husband must provide their consent, which cannot be given until at least three months have passed since the child’s birth. Once the required consent has been given, the commissioning couple can proceed with applying for joint adoption of the child.

If an adoption order is granted, all rights and obligations of the natural parents are terminated and transferred to the adoptive parents. The adopted child will be recognized in all aspects as the legal and biological child of the adoptive parents, and under no circumstances will be considered the child of any other individual.

By obtaining an adoption order, the commissioning couple assumes full parental rights and responsibilities, ensuring that the child’s legal status aligns with their new family unit.
