Yes, surrogacy is legal in Cyprus.  However, like UK and Australia, the surrogacy agreements are not enforceable and the surrogate mother is a legal parent who needs to give up her rights so that the commissioning parent can adopt via court order

If a single surrogate woman gives birth to a child and subsequently transfers the child to the intended couple, the legal framework outlined in Law 187/91 comes into effect. According to this law, the child is considered to be the child of the intended father and the surrogate woman, as the child is born out of wedlock. Establishing the paternity of the child in such cases can be done through voluntary acknowledgment or a Court order. 

Once a voluntary acknowledgment is made, it cannot be revoked. In this situation, it is necessary for the intended father to obtain the consent of the surrogate woman, due to the fact that as a birth mother, she is considered the legal mother of the child. Subsequently, the intended couple should proceed by applying to the court for the adoption of the child. The application should be made jointly by the intended father and his wife, who is the intended mother. 

In summary, if a single surrogate woman gives birth to a child and transfers parental rights to the intended couple, the intended father establishes paternity through acknowledgment or a Court order. Then, the commissioning couple must apply for adoption through a joint application made by the intended father and his wife. 

According to Cyprus Adoption Law 19(I)/1995, an adoption order can be granted if specific conditions are fulfilled. These conditions involve obtaining consent from the surrogate woman, who is considered the child’s natural mother in this case. The consent must be provided at least three months after the child’s birth. Additionally, it is required that the child has resided with the adoptive parents, namely the commissioning couple, continuously for the preceding three months. 

As per the adoption process in Cyprus, fulfilling these conditions allows for the possibility of obtaining an adoption order, which legally establishes the commissioning couple as the adoptive parents of the child. The law ensures that the child’s well-being and stability are taken into consideration throughout the adoption process. 

In a scenario where the surrogate woman is married and the child is the result of assisted procreation procedures conducted with the consent of her husband, the legal father is the surrogate’s husband rather than the intended father.

In such cases, both the surrogate and her husband must provide their consent, which cannot be given until at least three months have passed since the child’s birth. Once the required consent has been given, the commissioning couple can proceed with applying for joint adoption of the child. 

If an adoption order is granted, all rights and obligations of the natural parents are terminated and transferred to the adoptive parents. The adopted child will be recognized in all aspects as the legal and biological child of the adoptive parents, and under no circumstances will be considered the child of any other individual. 

By obtaining an adoption order, the commissioning couple assumes full parental rights and responsibilities, ensuring that the child’s legal status aligns with their new family unit.
