Intended Parents’ Eligibility Criteria in India (Surrogacy Act 2021)

Must be a married heterosexual Indian couple
Husband: 26–55 years and Wife: 25–50 years
Must have proven medical infertility (District Medical Board)
Must not have a surviving biological or adopted child (with limited exceptions)
Only altruistic surrogacy is allowed — no commercial payments
Must obtain: Certificate of Essentiality Certificate of Eligibility
Surrogacy must be done only through an ART-registered clinic
Sex selection is strictly prohibited
